ASIC oversees the licensing of trade repositories that accept reported transaction data. It also has the power under Part 7.5A of the Corporations Act 2001 to make derivative transaction rules. The rules require persons with a reporting obligation to report to a licensed trade repository, and require large financial institutions with a clearing obligation to centrally clear certain interest rate derivatives12.
Margin is not an ASIC matter. In Australia, the margin requirements for non-centrally cleared derivatives are set by a prudential standard of the Australian Prudential Regulation Authority (APRA).
