Mandatory clearing is the obligation, under Japan's Financial Instruments and Exchange Act, for a financial instruments business operator or a registered financial institution that enters into an OTC derivative transaction designated by the Commissioner of the Financial Services Agency to have its own obligations and its counterparty's obligations assumed by a financial instruments clearing organization (for interest rate swaps, including a foreign financial instruments clearing organization).
